Copyright Policy

NewsWaves respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, users who are repeat infringers.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on this site, you may notify our copyright agent as described below.

Filing a DMCA Notice

Important Notice

Filing a false DMCA notice may result in legal consequences. Please ensure you are the copyright owner or authorized to act on behalf of the copyright owner before submitting a notice.

To file a DMCA takedown notice, your written notification must include the following:

Identification of the copyrighted work

Describe the copyrighted work that you claim has been infringed. If multiple works are covered by the notice, provide a representative list.

Identification of the infringing material

Provide the URL(s) or specific location where the allegedly infringing material is located on our site.

Your contact information

Include your name, address, telephone number, and email address.

Statement of good faith belief

Include a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

Statement of accuracy

Include a statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Physical or electronic signature

Provide a physical or electronic signature of the copyright owner or person authorized to act on their behalf.

Please note that we may forward your DMCA notice, including your contact information, to the person who posted the allegedly infringing content.

Counter-Notice Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notice with our copyright agent. Your counter-notice must include:

  • Your physical or electronic signature
  • Identification of the material that was removed and its location before removal
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, telephone number, and email address
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or San Francisco County, California if your address is outside the United States)
  • A statement that you will accept service of process from the person who filed the original DMCA notice or their agent

Our Response Process

Upon receiving a valid DMCA notice, we will:

  1. Remove or disable access to the allegedly infringing material
  2. Notify the user who posted the material
  3. Provide the user with a copy of the DMCA notice
  4. Take appropriate action against repeat infringers, which may include account termination

If we receive a valid counter-notice, we may restore the removed content after 10-14 business days unless the copyright owner files a court action seeking an injunction.

Repeat Infringer Policy

Zero Tolerance

NewsWaves has adopted a policy of terminating user accounts that are determined to be repeat infringers. We reserve the right to terminate accounts at our sole discretion based on copyright infringement violations.

Misrepresentations

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing or was removed or disabled by mistake may be subject to liability. We reserve the right to seek damages from any party that submits a notification or counter-notification in violation of the law.
